For the purposes of terms + conditions, when referring to AS, party includes the likeness of Ashley Shubert, Ashley Shubert LLC., and Ashley Shubert Wellness Co. as well as all employees, contractors, volunteers, partners.
Your participation in any activities or AS programs indicates your acceptance of and agreement to all of the following terms as in effect from time to time, and any changes or updates to or replacements of these terms.
We may change, update, terminate and replace these terms, programs, benefits and activities from time to time, in whole or in part, at any time, and without notice or compensation, even though such actions may affect the programs, benefits and activities or your participation in such programs, benefits and activities.
Physical Movement Practices;
Physical movement classes, instruction and other activities are available to individuals in different forms, including through online livestream, digital classes, through member's access to recorded classes, and in person live outdoor events, live classes at any and all studios rented by ASW, and classes organized through AS. Not all participants in activities need to be members; however, participants in specific programs and activities agree to the additional terms and conditions of those programs and activities, certain of which are set forth below in these Terms and Conditions.
I understand that yoga includes physical movements as well as an opportunity for relaxation, stress reeducation and relief of muscular tension. Participation in class includes, but is not limited to, participation in meditation techniques, yogic breathing techniques, physical fitness, and performing various yoga postures whether online in-home, live outdoor events, or private instruction. Yoga postures, or asanas, are designed to exercise every part of the body―stretching and toning the muscles and joints, the spine and the entire skeletal system. They also work on the internal organs, glands and nerves. Yoga incorporates sustained stretching to strengthen muscles and increase flexibility. Yoga is an individual experience.
As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. I acknowledge that participation in movement classes exposes me to a possible risk of personal injury. I am fully aware of this risk. My acknowledgment agrees that I understand that in yoga, yoga sculpt, or any physical fitness class, I will progress at my own pace. If I experience any pain or discomfort, I will listen to my body, adjust the posture and ask for support from the instructor (the “Teacher”). I will continue to breathe smoothly. If at any point I feel overexertion or fatigue, I will respect my body’s limitations and I will rest before continuing yoga practice.
Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. I affirm that I alone am responsible to decide whether to practice yoga and take responsibility for seeking professional or medical support should I notice injury occur.
I hereby take action for myself, my executors, administrators, heirs, next of kin, successors and assigns as follows: I (a) irrevocably WAIVE, RELEASE AND DISCHARGE FROM ANY AND ALL LIABILITY for my death, disability, personal injury, property damage, property theft or actions of any kind which hereafter may occur to me, including my traveling to and from yoga classes, AS who is hosting these classes and where sessions are being held, and each of their directors, officers, employees, volunteers, representatives and agents; and (b) INDEMNIFY, HOLD HARMLESS AND AGREE NOT TO SUE the entities or persons mentioned in this paragraph as to any and all liabilities or claims made as a result of participation in the yoga, fitness, meditation, etc, classes, programs, trainings, events, or anything hosted by ASW, whether caused by the negligence of releasees or otherwise.
AS will not be held liable for any physical injuries sustained during yoga practices, physical workouts, trainings, workshops, retreats, in person events + classes, or online digital streaming.
Disclosure for Coaching
Coaching is not intended to be construed substitute for professional psychological, psychiatric, or medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified medical healthcare provider with any questions you may have regarding a medical condition or mental disorder. No warranties, either express or implied, are made on the information we provide.
AS will not be held liable for any personal, professional, emotional, or spiritual decisions made by participant throughout training programs, retreats, educational teachings or 1-1 coaching.
Terms of cancellation for coaching: Coaching packages are non refundable and non transferrable. Any cancellations made within 24 hours of scheduled sessions will be charged in full, requests to reschedule sessions prior to 24 hour window will be based availability and must be rescheduled within 7 days of original session.
ASW reserves the right to terminate coaching relationship at any point for any reason.
Photo Release;
I understand during yoga or fitness classes, meditations, and other related activities, whether live, in-person, digital classes, or livestream online, I may be photographed or recorded. I agree to allow my photo, video or film likeness to be used for any legitimate purposes by the Teacher.
I, hereby grant permission to AS to reproduce any portion of the photo images that have been taken during online livestream classes, digitally recorded workshops, live events + classes, teacher trainings, and retreats for the purpose of future promotions which can include but is not limited to, flyers, cards, calendars, invitations and websites without any compensation or recognition given to me.
Furthermore, I grant creative permission to alter the photograph(s) or video(s). I do not grant permission to resale or use the photographs or videos in a manner that would exploit or cause malicious representation toward me or my company and associates.
Terms of Membership;
All memberships are recurring monthly. Sutra (billing company used by AS) will automatically deduct membership fees from the payment method used to sign up on the same day each month. There is no activation fee.
If payment declines or bounces, student must update your payment method in order to use benefits of membership.
Commitment automatically renews each month unless student were to otherwise cancel their account. Cancellations and changes in membership type require 30 day notice prior to next billing cycle. Example: If it's the 15th of the month and billing cycle is the 20th, billing will take place that month and cancellation will occur for the following billing cycle.
To cancel or change the type of membership for account, please email info@ashleyshubert.com and cancellation will be processed within 24 hours/1 business day. There are no freezes and if cancellation occurs, membership rate cannot be continued or restarted.
COVID-19;
I understand that COVID-19 (including variations and mutations) is a highly communicable virus that can cause, among other conditions, severe respiratory illness, sometimes leading to death, in individuals who contract it.
I will not attend in-person activities conducted or organized by or through AS if I am exhibiting symptoms of COVID-19 (which can include fever, cough, shortness of breath or difficulty breathing, chills, repeated shaking with chills, muscle pain, headache, sore throat, new loss of taste or smell), or if I have been exposed to a third party who has exhibited COVID-19 symptoms in the 14 days preceding my participation in the activities.
I understand and expressly agree that my use of an AS space or participation in any other in-person activities conducted or organized by or through AS involves the risk that I could contract COVID-19 notwithstanding the mitigation measures in place by AS. I understand that these risks are inherent to my use of the facilities or participation in such activities and can range from mild symptoms to major illness, including death. I further understand and voluntarily accept full responsibility on my behalf for the risk of contracting COVID-19.
Travel Insurance;
Travel insurance is strongly recommended for all non-virtual AS retreats.
We strongly recommend purchasing insurance for the entire cost of your trip; transportation, airline, retreat fees and tuition, and any additional fees you plan to incur for the duration of the retreat.
Most travel insurances must be purchased at the time of your deposit.
Please read the fine print on your insurance plan; “cancel for any reason” insurance is strongly recommended as it will give you the most coverage.
Travel
AS, or team members or volunteers of, will not be held liable or responsible for compensating participants for any delay, additional expense, or inconvenience, injury, or loss that may be caused directly or indirectly by events outside of our control. (late arrival/departure of flights, civil disturbance, fire, flood, cyclones, severe weather, acts of God, pandemics, and acts of government, machinery, or equipment failure). No refunds will be given for cancellations, "no shows", or days not used resulting from the aforementioned, nor will refunds be given for late arrivals or premature departures.
Affirm + Payment Plans;
Once agreed to a payment plan with affirm, client is solely responsible to paying off the entirety of the program as monitored by Affirm* credit. No refunds will be available.
In the case a student or client is on a payment plan in agreement between AS and client individually, all deposits are nonrefundable and any additional funds are available as follows:
60-30 days from start of in-person retreat, 50% refund is available, less the deposit.
30 days from start of in-person retreat, no refund is available.
*Rates from 0–36% APR. Payment options through Affirm are subject to an eligibility check and are provided by these lending partners: affirm.com/lenders. Options depend on your purchase amount, and a down payment may be required. CA residents: Loans by Affirm Loan Services, LLC are made or arranged pursuant to a California Finance Lenders Law license. For licenses and disclosures, see affirm.com/licenses. For example, a $800 purchase could be split into 12 monthly payments of $72.21 at 15% APR or 4 interest free payments of $200 every 2 weeks.
Refund + Cancellation Policy;
No refunds are offered or given for in person, online, livestream, or recorded classes, events, or membership.
In the case of online retreats or mentorship, 50% refund is available if notice given prior to 30 days before the start of the program. If notice is given within the 30 day period, no refund is available.
For in-person retreats, (local + international) in the event participant wishes to cancel prior to 60 days before the retreat start date: Student will receive full refund of all tuition paid, less the deposit.
In the event participant wishes to cancel within 30-60 days prior to retreat start date:
If payment plan is in place, participant is still responsible for 50% of full amount of retreat, excluding deposit – which is nonrefundable.
If paid in full, 50% of balance outside of deposit is refundable.
In the event participant wishes to cancel within 0-30 days prior to retreat start date:
If payment plan is in place, participant is still responsible for 100% of balance due and remaining payments. If paid in full, no refunds will be available.
All deposits are non-refundable.
No transfers to other retreats or retreat dates are allowed upon cancellations.
Fulfillment + Shipping Policy;
All programs and services will be fulfilled upon date posted on webpage with all information.
Physical products are shipped within 5 business days.
